The figure of Francisco de Vitoria, founder of the so-called School of Salamanca and one of the most important professors of the University of Salamanca in the 16th century, has been considered on different occasions as an admirable model of a university professor. On one side, this article describes the scientific commitment of the School of Salamanca as a sign of an important dimension of university life: research. On the other side, the main features of Vitoria as (...) a teacher will be exposed. His teaching abilities will be taken into account, but also his capacity to involve other colleagues in a joint search for truth will be described. Finally, the renewing character of Vitoria’s Thomism in the framework of philosophy as a great ally of scientific dialogue will be considered. (shrink)

The article studies some of the most important political ideas present in the origins of the modern State, especially the notion of political sovereignty, which, borne and developed in the maiestas of the imperial roman law and in the averroistic interpretation of the aristotelian idea of the perfect community, is accepted and developed by Francisco de Vitoria in the De potestate civili. Vitoria and Suárez defend the categorical immunity of the innocent not to be intentionally killed. But they allow for inflicting collective punishment on the innocent and the noninnocent alike during and after a just war. So they allow for deliberately harming them. Inflicting harm on the innocent can often result in their death. Hence, holding both claims seems incoherent. First, the objections against using the term “innocent” are explained. Second, their views on just war are explored. And third, by (...) appealing to Aquinas' double-effect reasoning, it is shown how they try to avoid the above-mentioned incoherence. Still, their appeal might be insufficient to palliate the tension between the above-mentioned claims. If just wars are possible, the deliberate harming of the innocent is reasonably unavoidable for defeating and punishing those who wage them. Hence, defenders of just wars, whether from a religious or a secular perspective, must live with such a tension. (shrink)

This article exposes the concept of "second" Salamanca's School, i.e. the followers of Vitoria in a second generation that teach in Salamanca during the last years of the sixteenth century and the first years of the seventeenth. The author shows that there is an important continuity among the first and the second School and revisits the aspects which have been seen as negative for the School: the developing of metaphysics and the De Auxiliis controversy. The metaphysics as such cannot (...) be considered as a negative aspect and the De Auxiliis controversy has also some positive aspects, although it supposed a fatal tendency which determined the end of the School. [Encyclopedia entry] Born in Italy in 1225, and despite a relatively short career that ended around 50 years later in 1274, Thomas Aquinas went on to become one of the most influential medieval thinkers on political and legal questions. Aquinas was educated at both Cologne and Paris, later taking up (after some controversy) a chair as regent master in theology at the University of Paris, where he taught during two separate periods (1256-1259, 1269-1272). In the intermediate period he helped establish (...) a studium for his Order in Rome, beginning work on the Summa Theologiae, the masterwork for which he is still well-known. Subsequent to an experience (traditionally, a vision) Aquinas had on the feast of St. Nicholas in 1273, Aquinas intentionally refrained from further work on that text, so that it remained incomplete at the time of his death a year later in 1274. Apart from his own contributions, the Thomistic school – including followers within and without the Dominican Order to which Aquinas belonged – has had profound and far-reaching influence upon the history of legal thought in the West. Many of the classical developments of Thomistic thought are written as commentaries on the Summa Theologiae (hereafter, ST), including the works of Tomasso de Vio (Cajetan) and those of Domingo Banez, Francisco de Vitoria, Bartholome de las Casas, and the other highly influential members of the School of Salamanca who are noteworthy for developing Aquinas’ political and legal thought in the 16th century. Specifically, the ways in which Aquinas synthesized classical political and legal themes around the law, morality, and the common good provided a touchstone for what has come to be called ‘natural law jurisprudence.’ Natural law thinkers, in short, appeal to objective facts about what is good for human beings, and the social or political nature of the kind of creatures that we are, as a standard against which we measure the legal and social institutions created by human institutions. What is crucial here is that facts about human beings as social animals constitute reasons for individuals and groups to act or be structured in certain ways, such that ‘nature’ is the proper source for jurisprudential and political principles. The sixteenth century witnessed a major intellectual event: the birth of modernity. This book presents the School of Salamanca as the "first version of modernity", a modernity developed with a peculiarly Hispanic stamp. The Salamancans confronted the problems of a singular historical moment, in which Spain was playing a leading role in the encounter between Europe and America. The thinkers of Salamanca tackled crucial issues such as the right to property, economic ethics, freedom and slavery, the justice of war... In (...) the matrix of the Salamanca university, international law and the elements of reflection that would provide arguments for the abolition of slavery were born. This book brings together scholars from different geographical areas: several authors from Latin America, as well as from different European countries, sign their contributions. These diverse origins reflect the rich universality of the Hispanic project that had its heart in the reflections of the School of Salamanca. The diversity of topics addressed, ranging from the more practical questions of trade and the freedom of the American Indians to the subtleties of metaphysics or theology, is a good example of the richness of the issues addressed by those intellectuals who initiated modernity. La actual crisis sanitaria nos invita a repensar el actual modelo de salud, así como sus implicaciones antropológicas, sociales y económicas. A partir de una breve historia del concepto de salud, en este artı́culo tratamos de evidenciar los cambios que ese mismo concepto ha implicado a nivel de relación médico-paciente y a nivel de relaciones sociales. Un nuevo paradigma de salud, más ajustado a los nuevos fenómenos globales que están aconteciendo, implica también una critica a los enfoques individualistas, reduccionistas, tecnocráticos (...) y economicistas que se encontraban en la raı́z del “antiguo” modelo de salud. Por último, proponemos el modelo One Health como una posible respuesta a los problemas teóricos del “antiguo paradigma” de salud, fuertemente enfatizados por la crisis sanitaria actual. (shrink)

"Thinking a university for the 21st century" is the name of the research group at San Dámaso University (Madrid) that promotes this book. Over the last few years this group has held regular meetings to discuss the raison d'être of the university: what is a university?, what is its purpose?, what episodes of academic life have been most inspiring in the past?, which difficulties does university life face today?, what will be the future of the university?, what do we want (...) it to become? These are some of the questions that have been asked over the years and which now take the form of writing. Several of the contributions contained in this book have a certain historical orientation: the authors examine the highlights of the search for and communication of knowledge, from antiquity to the present day. Great figures such as Socrates, Thomas Aquinas, Vitoria, Newman, Ratzinger and Ortega are featured in these pages. However, this is not a history of university life in the past, but a reflection on the future. The examples of the past set us on the road to the university of the future. Such is the intention of this group of researchers, linked to different Spanish universities and also experienced in other institutions outside our country: they have gathered here to discuss the university we want to build in our present, with an eye to the future. This study aims to investigate the relationship between job burnout and employee performance in the feed industry during the ASF outbreak. Further, the researchers employed a descriptive-correlational research design in order to analyze the acquired data and produce pertinent findings. Thus, the researchers gathered data from one hundred two (102) feed industry employees. The Maslach Burnout Inventory (MBI) and Individual Work Performance Questionnaire (IWPQ) were employed to ascertain the extent of job burnout experienced by the respondents and evaluate employee performance, (...) respectively. Based on the statistical analysis, there is a significant relationship between job burnout and employee performance. Moreover, the study's findings were thoroughly analyzed and discussed. (shrink)

This aims to discuss the separation of the substance presented by Aristotle in Book Z of Metaphysics. In Z 1 the substance is prior in three aspects, namely as to the definition, the knowledge and the time. Aristotle's justification that substance is first in time is because it is the only category that is separate. Based on contemporary interpreters, we will discuss the separation as ontological separation associated with the definitional separation.

Some of the central questions that have been explored by Latin American and Latinx philosophers are questions of metaphilosophy. "Metaphilosophy" refers to philosophical reflections on the nature of philosophy itself. For example, we might ask: What is the purpose of doing philosophy? How does philosophy compare and contrast with other disciplines, such as science, theology, or literature? And what is the best way of categorizing the different kinds and traditions of philosophy? These are philosophical questions about philosophy as an activity (...) and as a discipline. In this chapter, we discuss some ways that Latin American and Latinx philosophers have addressed these and other metaphilosophical issues. Our focus will be on the following questions: What are the defining characteristics of Latin American philosophy and Latinx philosophy? Do they constitute distinctive traditions of philosophy, and if so, what is especially valuable about these traditions? (shrink)

It has been said that all philosophy begins with a set of concerns and a set of intuitions. With this idea in mind, we ask: Would it be helpful to understand Mexican-American philosophy as a kind of philosophy that begins with the concerns and intuitions of the Mexican-American community? On this view, what distinguishes Mexican-American philosophy is the orientation from which the philosophical investigation proceeds. Such an orientation is shaped by the experiences and relationships that are characteristic of those who (...) identify as Mexican-American. We offer a list of concerns and intuitions that we suggest are widely held by the Mexican-American community. Focusing on questions surrounding linguistic assimilation in the U.S., we illustrate how beginning from these particular starting points might alter the way we think about philosophical issues. O presente artigo relata a estética de classe de um grupo social que foi chamado de pirangueiro. A partir de uma pesquisa observacional, com amparo referencial nas teorias do habitus e do campo, em Bourdieu, baseada na técnica de flanagem, reconstruiu-se a ideia do subcampo da moda de resistência, que se apresenta como contraposição ao campo da moda dominante. Com essa moda de resistência, o jovem pirangueiro traz um elemento de auto-distinção e, ao mesmo tempo, um critério de preconceito.

O presente trabalho teórico e bibliográfico se dedica a reconstruir o conceito de declinação espontânea do átomo em Epicuro, tal qual Marx defendeu em sua tese de doutorado. Seu objetivo é descobrir se a clinamen do átomo está presente em Epicuro e, se está, como se pode pensá-la. Percebe-se que a clinamen que aparece nos textos remanescentes de Epicuro não traz a noção de declinação espontânea, como aparece em Lucrécio e Marx, como Quartim de Moraes afirma. Entretanto, tendo como base (...) as premissas fundamentais de Epicuro, conclui-se que é necessário, ao sistematizar o seu pensamento, introduzir a noção de declinação espontânea para não reduzir sua filosofia ao determinismo e ao fatalismo. A clinamen não é um absurdo no pensamento de Epicuro, mas é uma questão fundamental que passa por toda sua filosofia e que poderia estar presente nas obras perdidas deste autor, assim como Marx pensou. Fundamentalmente, como filósofo da felicidade, Epicuro introduz a clinamen como declinação da vida infeliz. (shrink)

One of the most disputed questions among economists is that of "the role" and "size" that the public sector should have in a rich and developed country like France. -/- The importance of this question is understandable, because the history of nations is filled with examples of a sector (or a branch) of the economy becoming too large, or remaining too small, hampering growth or making the economy more vulnerable. A recent case is that of the "Financial Corporations Sector", which (...) doubled in size in several countries during the two decades leading up to the 2008 economic collapse [1]. -/- It is therefore legitimate to ask whether this is not also the case, in France, with "General Government" or "the Public Sector". -/- We explain why the argument most often used by those who hold this opinion (that the ratio "public expenditure/GDP" is a good measure of the size of the public sector and that in France it is too high) is not a serious one. -/- . Transdisciplinary research knits together knowledge from diverse epistemic communities in addressing social-environmental challenges, such as biodiversity loss, climate crises, food insecurity, and public health. This paper reflects on the roles of philosophy of science in transdisciplinary research while focusing on Indigenous and other subaltern forms of knowledge. We offer a critical assessment of demarcationist approaches in philosophy of science and outline a constructive alternative of transdisciplinary philosophy of science. While a demarcationist focus obscures the complex relations between epistemic communities, transdisciplinary (...) philosophy of science provides resources for meeting epistemic and political challenges of collaborative knowledge production. The present article studies the epictetean philosophical use of some passages of the Greek and Roman history. The concepts of love-friendship (philía) and personal con- venience (sumphéron) second the philosopher to explain why happiness (eudaimonía) has not been reached by the human being in all history. All historical war or strife (pólemos), such as the Trojan, the Medics and the Peloponnesian wars, is provoked by epistemological-moral mistakes derived from the ignorance of which is the correct place to put the sumphéron; (...) such correct place is only the personal “rational capacity” ( proháiresis). This causal explanation of the incorrect and vicious human actions, of which history is full and which destroy the existent philía between nations and provoke pólemos, constitutes an authentic epictetean philosophy of history. Nevertheless, those vicious actions have a justification in a superior Cosmological level because they are pre-determined and ordered by the God-Providence. This leads us to the possibility of observing that the stoic philosophy of history, particularly the epictetean, is analogous to some modern speculative systems of history like the ones developed by Vico or Hegel. Hay doble pulsión en el centro de la discusión del razonamiento deductivo. Una conduce aparentemente a la abstracción y dominios arbitrarios, mientras que la otra conduce a la concreción y la dependencia del contenido. El objetivo de esta investigación es diseñar, aplicar y validar un instrumento de evaluación que nos permita corroborar si el razonamiento deductivo maneja reglas lógicas o contenidos. La muestra de estudio se compuso de 80 participantes (edad 18-77 años). El test consta de 60 ítems categorizados en: (...) formalidad, integrabilidad, complejidad y modalidad. Los resultados ponen de manifiesto la fiabilidad del test de razonamiento deductivo con un alpha de Cronbach. 775 y con un índice de validación. 850 para el índice de inteligencia no verbal (INV) del RIAS. Cómo conclusión inferimos que el razonador deductivo no dispone de un cuerpo preciso de reglas generales deductivas, sino que usa colecciones de reglas heurísticas cada vez menos abstractas. El estudio de la etnicidad ha presentado tradicionalmente una serie de dificultades. La razón última de ello estriba en la naturaleza dinámica y difusa de las identidades sociales. Este artículo reconstruye el origen intelectual de tales dificultades y la importancia de la idea de contingencia para una consideración normativa de la etnicidad. Tras repasar los principales modelos de ciudadanía moderna, el texto analiza el papel de los inmigrantes en la estructura de derechos civiles y concluye con una reflexión sobre las (...) posibilidades abiertas en la sociedad española para un modelo pluralista de integración. This article is an attempt to approach what is currently called human trafficking among legal circles and journalistic discourses, from an aesthetic-technological perspective, as a technology that seeks to produce an experience of the obliteration of bodies. Firstly, we make a characterization of the way these discourses operate, as well as of their effects in order to indicate just how incapable of pondering aesthetic-technological functioning they are, as far as the technology experience postulated herein. In the final part the article, (...) a series of elements and mechanisms of what would constitute that technology of experience is enumerated. In conclusion, a conceptual supplement is offered that seeks to characterize a mechanism of non-recognition at the center of this technology of experience. (shrink)

El presente trabajo pretende ser un guía y un prontuario para que el profesorado de filosofía haga uso de los conocimientos lingüísticos del alumnado. A dichos conocimientos se dedican muchas horas de trabajo escolar y pueden ser utilizados para mejorar el desempeño del alumnado en las materias de filosofía. Por otra parte, los productos de éstos que se evalúan en las materias de filosofía son de naturaleza lingüística, por lo que tal vez conviene una cierta sintonía con las materias correspondientes (...) en lo que se refiere a la evaluación de sus producciones lingüísticas. La exposición se basa en un doble hilo conductor. El primero, que estructura secuencialmente el trabajo, sigue las propiedades habituales que se consideran en un texto: cohesión, coherencia y adecuación. Estas propiedades sirven para introducir la teoría relevante que pueden servir al profesorado de filosofía para encontrar en los textos de lingüística lo que busca en orden a mejorar las habilidades de expresión y comprensión de su alumnado. Se complementa con la sugerencia de criterios de evaluación para las producciones textuales del mismo. El segundo hilo conductor se basa en diversos problemas de comprensión de textos. (shrink)

Ciertos trabajos nietzscheanos se atarean en la concepción de una memoria tocante a los conceptos de la historia y de lo humano. Tal concepción implica una cierta política. Allí, la memoria es transformada en el aprendizaje de una respuesta humana ante lo que acontece que queda remitida a lo por venir. Se trata de un artículo que busca una relectura de los textos y problemas en la obra del filósofo francés Louis Althusser. Hay dos líneas argumentativa que sigue la relectura: 1) su materialismo aleatorio, y 2) su teoría del lenguaje.

O presente trabalho constrói uma ponte teórica entre Hegel e Marcuse, com intento de demonstrar a possibilidade de transformações históricas concretas, oferecida pela experiência estética. Tendo como paradigma a sociedade administrada, procurou-se estabelecer, a partir de Marcuse e Hegel, um caminho que demonstra como o indivíduo plasma a razão na história, o que pressupõe uma ação libertadora consciente. Todavia, em uma sociedade unidimensional, não há abertura para outras dimensões e, portanto, a razão unidimensional se torna totalitária, paralisando a história. Nesse (...) sentido, buscou-se demonstrar a saída para a dimensão estética, que propicia uma negação da unidimensionalidade da razão moderna. O indivíduo bidimensional, ie, que está aberto para a realidade e para a dimensão estética, pode plasmar a razão na história e, portanto, transformar o mundo. (shrink)

Despite being a women's problem for a long time, catcalling has recently attracted lawmakers' attention. In 2019, the Philippine government enacted Republic Act 11313, or the Safe Spaces Act, which prohibits and punishes gender-based sexual harassment. However, despite the existence of the law, catcalling continues to be rampant. This study aims to explore the experiences of women in Quezon City who have been subjected to catcalling and to provide answers regarding the effects of catcalling on the victims, the locations where (...) catcalling is most prevalent, the most common perpetrators, and the victim's views on the Safe Spaces Act. This research uses a qualitative descriptive approach. Purposive sampling was used to select respondents, and respondents were interviewed using an interview guide to gather information. The findings indicate that women are most vulnerable to catcalling in public spaces, and the perpetrators are strangers or bystanders. Victims went through mental, emotional, and behavioral changes after the incident. Moreover, not all victims think that the law effectively addresses the problem because catcalling is still prevalent, and public awareness campaigns are lacking. (shrink)

¿Un proyecto de humanidades planeado y desarrollado usando tecnología digital se inscribe aún en la tradición de las disciplinas de los estudios humanísticos, o bien se trata de otra cosa? ¿Habrá una diferencia real entre un proyecto hecho con las formas usuales de investigación en las humanidades y un proyecto hecho con tecnología digital? ¿Cómo evaluar la diferencia? ¿La hay?

Por medio de un contraste con el pensamiento heideggeriano, el estudio desarrolla la concepción gadameriana de la alteridad, el lugar que ocupa este tema en la propuesta hermenéutica de Verdad y Método y la reformulación que ello supone de la manera como Heidegger concibe la aperturidad de la existencia humana y el acontecimiento mismo del ser. El trabajo inicia planteando la crítica de Gadamer al reconocimiento ontológico del otro por parte de Heidegger; muestra enseguida la oposición que se presenta entre (...) el “ser-para-la-muerte” y el “ser-para-la-historia”, la relevancia que tiene en Gadamer la vida práctica y la idea de diálogo como modelo de la comprensión. Se concluye mostrando la oposición que se da entre ambos autores en la manera de considerar el modo de ser del lenguaje y el acontecimiento del ser que en éste tiene lugar. [/] -/- In permanent contrast with Heidegger’s thought, this study develops Gadamer’s conception of otherness, its place in the hermeneutic project of Truth and Method and the reformulation that all this entails of human existence disclosedness and the event of being itself. Work starts raising Gadamer’s critique to the ontological [42] recognition of the others by Heidegger; it shows then the opposition between the “being-towards-death” and “being-for-history”, and the relevance of practical life and the idea of dialogue as a model of understanding in Gadamer’s philosophy. It concludes by showing the opposition between both authors regarding language’s essence and the event of being that takes place on it. (shrink)

Se revisa la cuestión del poder del lenguaje en una comparación entre las teorías del lenguaje de la sofística antigua y las de los pensadores franceses Gilles Deleuze y Louis Althusser.

In this paper, I reconstruct Davidson’s explanation of first person authority and criticize it in three main points: (1) The status of the theory is unclear, given that it is phenomenologically inadequate. (2) The theory explains only that part of the phenomenon of first person authority which is due to the fact that no two speakers speak exactly the same idiolect. But first person authority might be a more far-reaching phenomenon than this. (3) Davidson’s argument depends on the claim that (...) “not getting one’s words wrong” is the same as “knowing what one’s words mean”. I argue that the two are not the same. In conclusion, I sketch some alternatives to Davidson’s account. I argue that the most promising one attempts to explain first person authority by examining how we acquire second-order beliefs. A well-known remark of Evans’s proves useful for such an account. (shrink)

[ENG] On the basis of a reading of Heidegger's Der Ursprung des Kunstwerkes, the problematic of understanding the relational concepts of "earth" and "world" is developed. The proposal here is situated from an existential approach that links the earth with the concepts of sublimity and world, understood on the basis of an opening within imagination. To articulate these ideas, this paper fundamentally draws from arguments by Kant, Nancy and Arendt. The proposal here is that Heidegger seeks to explain how the (...) tear caused by the earth in the work of art would sublimate the imagination in an openness towards the world. -/- [ESP] A partir de una lectura del artículo Der Ursprung des Kunstwerkes escrito por Heidegger, se desarrolla la problemática de comprender los conceptos relaciónales de tierra y mundo. La propuesta aquí se sitúa desde una perspectiva existencial que liga la tierra con los conceptos de sublimidad y el mundo, comprendidos desde una apertura en la imaginación. Para articular estas ideas, el presente escrito se apoya fundamentalmente en argumentaciones de Kant, Nancy y Arendt. Lo aquí propuesto es que Heidegger buscaría dar cuenta del modo en que la desgarradura causada por la tierra en la obra de arte sublimaría la imaginación en una apertura hacia el mundo. (shrink)

El trabajo consiste en una elucidación de los elementos que conforman el concepto de pena natural (poena naturalis) en el Derecho penal. Se puede caracterizar la pena natural como el daño o sufrimiento que recae sobre el autor de un delito, producto de la comisión del mismo, que debe ser descontado de la pena legal que ha de aplicársele. Si bien existe un mínimo acuerdo sobre esto, tanto en la jurisprudencia como en la doctrina penal se observan serios desacuerdos acerca (...) de los requisitos que se deben cumplir para reconocer que se está frente a una pena natural. Para elucidar los elementos, se utilizará el constructivismo conceptual de Ronald Dworkin, a fin de describir el desacuerdo y sus implicancias, reconocer los elementos principales de la pena natural y justificarlos bajo su mejor luz moral. ABSTRACT This study focuses on the clarification of the conceptual elements of poena naturalis in criminal law settings. The poena naturalis is the damage or suffering that falls on the convict for its commission. This damage must be deducted from the poena forensis to be applied. Although there is a minimum agreement about the concept of poena naturalis, in the jurisprudence and among legal scholars, there are serious disagreements about the elements of poena naturalis. To elucidate the elements, I will adopt Ronald Dworkin’s conceptual constructivism to describe the disagreement and its implications. At last, I will justify the main elements of the poena naturalis by their best moral light. (shrink)

La mal llamada “Conquista del Desierto” constituyó una serie de campañas militares ocurridas en el actual territorio patagónico argentino entre los años 1878 y 1885 cuyo resultado fue el asesinato, la violación y sometimiento a la esclavitud de diversos pueblos y comunidades indígenas. Este no fue un caso aislado, sino que se suma a una serie de ataques sistemáticos que han sufrido los indígenas en la Argentina. En los últimos años, a raíz del reclamo y las luchas de los pueblos (...) y comunidades indígenas, así como también de las organizaciones de derechos humanos, se han comenzado a juzgar algunos de estos hechos. En particular, la Masacre de Napalpí (1924) y la Masacre de La Bomba (1947) fueron los primeros que lograron respuestas judiciales favorables. En ambos se determinó que el accionar estatal era constitutivo de un genocidio y, por lo tanto, se debía resarcir a las comunidades actuales. Ahora bien, la Campaña del Desierto, al día de hoy, no tiene respuesta por parte del Estado. Teniendo presente este panorama, nuestro objetivo en este trabajo es reconstruir los diferentes problemas que enfrenta la posibilidad del reclamo judicial. Para ello, comenzaremos describiendo en qué consistió la Campaña del Desierto. Luego, explicaremos la noción de genocidio aplicado a hechos de injusticias históricas. Como tercer paso, reconstruiremos los casos jurisprudenciales que se han preocupado por genocidios indígenas ocurridos en el pasado. Con este panorama revelado, nos enfocaremos en los diferentes problemas jurídicos y políticos que surgen en los reclamos de justicia. (shrink)

El presente trabajo se propone rastrear la influencia de la tradición platónica Acerca de los primeros principios, en sus diversas formulaciones, sobre la filosofía de Orígenes de Alejandría. La lectura origeniana de los autores platónicos y su afinidad con ellos se confirman en las fuentes históricas. El alejandrino adopta y asimila numerosos aspectos de la doctrina y la terminología de los seguidores de Platón. Sin embargo, también toma distancia de ellos en algunos puntos neurálgicos de su concepción de lo divino (...) y de la creación del mundo. Se analizan especialmente los papeles que cumplen en la teoría origeniana las categorías académicas de lo absoluto y lo relativo, la noción mesoplatónica y filoniana del agente demiúrgico y una original adaptación del esquema causal derivativo neopitagórico. -/- The present paper intends to trace the influence of the Platonic tradition On first principles;, considering its different versions, on the philosophy of Origen of Alexandria. Origen's knowledge of the Platonists and his affinity with them are confirmed by the historical sources. The Alexandrian adopts and assimilates many aspects of the doctrine and terminology of Plato's followers. However, he also departs from them regarding some of the essential elements in his conception of the divine and of the world's creation. Particularly, the paper focuses on the roles played in Origen's theory by the Academic categories of absolute and relative, the Middle-platonic and Philonian notion of the demiurgic agent and an original reframing of the Neopythagorean derivative system of causes. Our purpose is to describe the application of legitimate defense in so-called non-confrontational situations. To do this, we will conceptualize gender violence as that which against women, due to their condition as such, and we will describe the absence by the courts in the identification of this problem. Second, we will analyze the reception of Argentine and international legislation on the treatment of gender violence and the recommendations and criteria to take into account when interpreting and applying criminal law. Finally, (...) we will present the treatment of legitimate defense in contexts of gender violence, analyzing each of its elements. Our conclusions will focus on the need to address situations of gender violence based on international regulations for the application of legitimate defense in non-confrontational situations. (shrink)
